PROPOSED AMENDMENTS
TO BY-LAWS OF
MONROE COUNTY COUNCIL
DEPARTMENT OF THE STATE OF NEW YORK
VETERANS OF FOREIGN WARS OF THE UNITED STATES
PROPOSAL 1
Whereas the Veterans of Foreign Wars National By-Laws Article III, Sec. 301 refers the formation of County Councils to the Departments having jurisdiction, and having no other reference to County Councils
and
Whereas, the Department of New York being such jurisdiction
and
Whereas, Monroe County Council, a council within said jurisdiction
and
Whereas, the By-Laws of said council refer to sections of the National By- Laws no longer in effect or existence,
and
Whereas, there are only eighteen posts within Monroe County,
The following Proposed Amendments are made.
Be it resolved to:
1. Amend Article One, Section 1.b. to read: The Council shall consist of the eighteen current Member Posts, all located in Monroe County (Appendix A) and any newly formed Post in Monroe County or an adjacent County, that elects to affiliate itself with this Council in accordance with ARTICLE V, Sec. 2.02 of the Department of New York By-Laws.
2. Amend Article One, Section 1.b)(1) to read: Posts wishing to disaffiliate from the Council must comply with the requirements of ARTICLE V, Sec. 2.02 of the Department of New York By-Laws.
3. Amend Article One, Section 1.c to read: The County Council shall be composed of those individuals enumerated in ARTICLE V, Sec. 2.01 of the Department of New York By-Laws.
4. Amend Article One, Section 1.e)(1) to read: The Quartermaster of the County Council shall qualify and secure a bond in a sum at least equal to the amount of the liquid assets for which he may be accountable in accordance with Section 703 of the National By-Laws
5. Amend Article 2, 2.b)(1) to read: The County Council shall have at least the minimal number of regular meetings each calendar quarter as specified in ARTICLE V, Sec. 2.04 of the Department of New York By-Laws.
6. Amend Article 2, 2.c. to read: Special Meetings will be called in accordance with ARTICLE V, Sec. 2.04 of the Department of New York By-Laws.
7. Amend Article 3, 3.a. to read: County Dues shall be billed to Member Posts by the Council Quartermaster in July of each year, based on their May 31st membership as recorded by the Department of New York, at a rate not in excess of that stated in ARTICLE V, Sec. 209 of the Department of New York By-Laws.
8. Amend Article 3, 3.e to read: The County Council may solicit funds as authorized in ARTICLE V, Sec. 210 of the Department of New York By-Laws.
9. Amend Article 4.a to read: The elected officers of the Monroe County Council, their nomination, election or appointment, and installation shall be in accordance with the provisions of the By-Laws of the Department of New York.
10. Amend Article 4.a)(1) to read: In addition to the Officers of this Council, whose election or appointment is mandatory under the provisions of the By-Laws of the Department of New York, the Council shall elect a County Inspector and may elect an Assistant Quartermaster and / or an Assistant Chaplain.
11. Amend Article 4, 4.b. to read: The duties of all the Officers of the County Council shall be those prescribed in Sec. 418 of the National Manual of Procedure pertaining to the duties of District Officers for each office common to both County Council and District, substituting the term “County Council” where the term “District” appears.

PROPOSAL 2
Whereas ARTICLE V, Sec. 2.04 of the Department of New York By-Laws require that County Councils hold at least one (1) regular meeting each quarter
And
Whereas the County Council Commander may call a special meeting whenever, in his judgment, it shall appear to be for the best interests of the members within the jurisdiction of the Council
And
Whereas the Objectives of the Council can be met by holding meetings less than monthly
Be it resolved to:
Amend ARTICLE 2, Sec. 2.a to read: The County Council shall hold a bi-monthly meeting at such time and place as shall, from time to time be determined by the County Council in session duly assembled.

PROPOSAL 3
Whereas There are no specific Committee Chairman posts associated with any specific elected office
And
Whereas Committee Chairman posts vary at each echelon of the organization
Be it resolved that:
The duties of the Elected Officers shall not be assumed unless otherwise stated the By-Laws of Monroe County Council, Eighth District By-Laws, By-Laws of the Department of New York or the National By-Laws and Manual of Procedure.
And
Be it further resolved that:
All appointments as Committee Chairmen be duly announced and recorded in the minutes of regular scheduled meetings
